1. Acceptance of Terms

Welcome to ShotScout ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website, mobile application, and photography planning services (collectively, the "Service") operated by ShotScout.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

ShotScout is a photography planning platform that provides:

• Location-based photography planning tools
• Weather and lighting condition forecasts
• Celestial event tracking and notifications
• Photography location management
• Personalized photography reports and alerts

3. User Accounts

3.1 Account Creation

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account

3.2 Account Termination

You may terminate your account at any time through your account settings. We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

4. Subscriptions, Billing, and Cancellation

4.1 Membership Plans

ShotScout offers a free 30-day trial ("Explorer", no payment card required) and two paid subscription tiers ("Scout" and "Professional"), billed monthly or annually in advance, in the currency you select at checkout. Current pricing and feature limits for each tier are shown on our pricing page and in your account dashboard.

4.2 Payment Processing

All payments are processed by Stripe, Inc., a third-party payment processor. We do not store your full card details on our own servers - see our Privacy Policy for details on how payment information is handled.

4.3 Auto-Renewal

Paid subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You authorize us (via Stripe) to charge your chosen payment method for each renewal.

4.4 Cancellation

You may cancel your subscription at any time from your account's Billing page. Cancellation stops future billing, but you will retain access to your plan's features until the end of the billing period you have already paid for - cancelling does not cut off access immediately.

4.5 Refunds

We do not offer refunds for partial billing periods or for time remaining on a cancelled subscription. Because every paid tier is preceded by a full-featured free trial, you are able to evaluate the Service before paying anything. If you believe you were charged in error, contact us at the email below and we will review it.

4.6 Failed Payments

If a renewal payment fails, we will retry the charge automatically and your access will continue during this retry period. If payment continues to fail, your account will be moved to a restricted state until payment succeeds or you cancel.

4.7 Price Changes

We may change subscription pricing from time to time. Any price change will not affect a billing period you have already paid for, and we will give you reasonable advance notice before a price change takes effect on your next renewal.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated systems to access the Service without permission
• Impersonate others or provide false information

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Service, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

7. Intellectual Property Rights

7.1 Our Content

The Service and its original content, features, and functionality are owned by ShotScout and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 User Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating and providing the Service.

8. Third-Party Services

Our Service may contain links to third-party websites or services that are not owned or controlled by ShotScout. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

9. Service Availability

We strive to provide reliable service but cannot guarantee that the Service will be available at all times. The Service may be subject to:

• Scheduled maintenance and updates
• Unscheduled downtime due to technical issues
• Interruptions due to third-party service dependencies
• Force majeure events beyond our control

10. Disclaimers and Limitation of Liability

10.1 Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Weather and astronomical data provided through the Service is for informational purposes only and should not be relied upon for critical decisions.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SHOTSCOUT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless ShotScout and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where ShotScout is established, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

Your continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
